Terms of Use

Acceptance. These Terms of Use ("Terms") is a legal agreement between you and Too Many Words Inc. ("TMW"), the owner and operator of this Web site (the "Web site"). It states the terms and conditions under which you may access and use the Web site. By accessing and using the Web site, you are indicating your acceptance to be bound by these Terms. If you do not accept these Terms, you must not access or use the Web site. 

Copyright. All materials displayed or otherwise accessible through this Web site (collectively, "Content") are protected by copyright law, and are owned by TMW and its licensors, or the party accredited as the provider of the Content. Any use of the Content, including modification, transmission, presentation, distribution, republication, or other exploitation of the Web site or of its Content, whether in whole or in part, is prohibited without the express prior written consent of TMW.

Rules and Conduct. You will not: (i) use any device, software or routine to interfere with or attempt to interfere with the proper working of the Web site or any activity being conducted on or through the Web Site; (ii) attempt to decipher, decompile, reverse engineer, or disassemble any of the software comprising or making up the Web site and/or the Content; (iii) delete or alter any material posted on the Web Site, including the Content; and (iv) use the Web site in a manner which is contrary to law, or which would adversely impact use of the Web site by other users, including the posting or transmitting of information or software containing viruses or other disruptive components. 

Links. The Web site contains links to third-party Web sites. These links are provided solely as a convenience to you and not as an endorsement by TMW of the contents of such third-party Web sites. TMW is not responsible for the content of any third-party Web site, nor does it make any representation or warranty of any kind regarding any third-party Web site.

Disclaimer of warranties. The Web site and the Content is provided "as is". No representations or warranties are made regarding the Web site and/or the Content including, without limitation, no representation or warranty that (i) the Web site or Content will be accurate, complete, current, timely or suitable for any particular purpose; (ii) that the operation of the Web site will be uninterrupted or error-free; (iii) that defects or errors in the Web site or the Content will be corrected; (iv) that the Web site will be free from viruses or harmful components; and (v) that communications to or from the Web site will be secure and/or not intercepted. You acknowledge and agree that you are using the Web site at your own risk and liability.

Limitation of Liability. IN NO EVENT WILL TMW BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF, RELIANCE UPON, OR INABILITY TO USE THE WEB SITE OR THE CONTENT, OR ANY OTHER SITE YOU MAY ACCESS THROUGH THIS WEB SITES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Trade marks. Geordie Sabbagh Productions and the logo are trade marks of TMW. Other names, words, titles, phrases, logos, designs, graphics, icons and trade marks displayed on the Web site may constitute registered or unregistered trade marks of TMW or third parties. 

Governing Law and Jurisdiction. By accessing or using the Web site, you agree that all matters relating to your access to, or use of, the Web site and its Content shall be governed by the laws of the Province of Ontario and the laws of Canada, without regard to conflict of laws principles. You agree and hereby submit to the non-exclusive jurisdiction of the courts of the Province of Ontario with respect to all matters relating to your access to and use of the Web site.

Termination. TMW may, in its sole discretion, cancel or terminate your right to use the Web site, or any part of the Web site, at any time without notice. In the event of termination, you are no longer authorized to access the Web site or the part of the Web site affected by such cancellation or termination. The restrictions imposed on you with respect to both Content and the Web site set out in this Agreement shall survive. TMW shall not be liable to any party for such termination.

Miscellaneous. This is the entire agreement between you and TMW relating to your access and use of the Web site and the Content herein. If any term or provision of this Agreement is held by a court of competent jurisdiction to be invalid, it shall be severed and the remaining provisions shall remain in full force without being invalidated in any way. TMW may revise these Terms at any time by updating this posting. Use of the Web site after such changes are posted will signify your acceptance of these revised terms. TMW reserves the right to change or remove any content from the Web site, including the Content, in whole or in part, at its sole discretion, at any time, without notice. TMW's failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right.
